Terms and conditions

1. Who we are

Gaard Audio is the trading name of Morten Nørgaard, a sole trader in Denmark. When these terms say "we", "us" or "Gaard Audio", they mean Morten Nørgaard. When you use this website or VariBlend, your agreement is with Morten Nørgaard.

2. Accepting these terms

By using this website, buying a licence or installing our software, you agree to these terms. If you do not agree, please do not use the website or the software.

3. Orders and payment

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries about payments and handles returns.

Prices, payment, taxes and refunds for your order are covered by Paddle's buyer terms. Our refund policy explains how to get your money back.

4. Your software licence

When your payment is complete, you receive a personal serial by e-mail. The serial gives you a lifetime, non-exclusive, non-transferable licence to use the software you bought, subject to these terms. Unless we say otherwise for a specific product:

  • You may install and use the software on the computers you use yourself, for example a studio computer and a laptop.
  • Your serial contains your name and e-mail address and is for you only. Do not share it, publish it or sell it.
  • You may not copy, rent, resell or distribute the software, or remove or bypass its registration.
  • You may not decompile, disassemble or modify the software, except where the law allows it.
  • Updates we release for the product you bought are included in your licence. We decide what an update contains and when it is released.

The licence is sold to you, not to a company. If you need licences for an organisation, contact us.

5. Your music and audio

You keep all rights to the audio you process with our software and to the music you make with it. You may use it commercially without paying us anything more. We claim no rights in your recordings.

You are responsible for having the right to use the audio you process. If you believe that material on this website infringes your rights, e-mail us with the details. We remove infringing material promptly, and we end the licence of anyone who repeatedly infringes the rights of others.

6. Using the website fairly

You may not use this website or our software:

  • for anything unlawful, or to commit fraud;
  • to send spam or unwanted messages, for example through the contact form;
  • to infringe our intellectual property or anyone else's;
  • to interfere with security: spreading malware, probing for weaknesses, overloading the website or scraping it automatically.

7. Who owns what

The software, the VariBlend and Gaard Audio names, this website and everything on it belong to Morten Nørgaard or are used with permission. Buying a licence gives you the right to use the software. It does not transfer ownership of the software or its intellectual property.

8. Availability and quality

We work hard to make our software and website reliable, but we cannot promise that they are free of errors or always available. Always keep backups of your projects. Your statutory consumer rights, including the right to software that matches its description, are not affected.

9. Ending a licence

We may suspend or end your licence, and disable your serial, if:

  • you seriously or repeatedly break these terms, for example by sharing or selling your serial;
  • the payment is refunded or charged back, or was not completed;
  • the purchase was fraudulent, or the serial puts the security of our software at risk.

10. Liability

To the extent the law allows, our total liability to you is limited to the amount you paid for the product concerned. We are not liable for indirect losses such as lost profits or lost data. Nothing in these terms limits liability that cannot be limited by law, for example for gross negligence or intent.

11. Law and disputes

These terms are governed by Danish law. If you are a consumer, you also keep the protection of the mandatory rules of the country you live in. If something goes wrong, please contact us first. Most problems are solved quickly by e-mail.

12. Changes

We may update these terms. The date at the top shows the latest version. Changes do not take away rights you already have for a licence you bought earlier.
